要实现贵州工业强省战略,必须充分调动工业中“劳动者”这一中心要素,而和谐劳动关系的建立正是它的前提条件。当前贵州省正处于巨大的经济和社会转型期,在和谐劳动关系的建立上出现了许多新问题和新现象。本文基于贵州省社会科学院的专题调研,分别从劳动争议(个人劳动争议和集体劳动争议)、集体协商与集体合同制度建设、国有企业劳动关系、非公有制劳动关系、劳动关系中的农民工问题、劳动关系中政府与工会的角色这六个方面,揭示了贵州劳动关系的现状,分析了阻碍和谐劳动关系的因素。并在贵州工业强省战略背景下,就构建和谐劳动关系提出一系列相应的政策建议。
<<Based on the special survey carried by Guizhou Academy of Social Sciences,this article reveals the current situations of Guizhou labor relations and analyzes the factors that block harmonious labor relations from following seven aspects:individual labor dispute and collective labor dispute,collective negotiation and construction of collective contract system,labor relations of the state owned enterprise,labor relation of non-public ownership,migrant workers’ problems in labor relation,and the role of government and labor union in labor relation. Meanwhile,under the construction of powerful industrial province,this article presents a series of suggestions flowing on constructing harmonious labor relation. Reconsider the labors’ rights and interests in transitional period and alter policies and systems of labor disputes;improve consultative machinery that is led by government and promote the organization and capacity construction both of the labor and capital;optimize the state-owned enterprises’ contracts and democracy machinery and rebalance the labor relation;intensify the labor and social security systems such as labor contract,social insurance and minimum wages;establish the wages guarantee machinery for migrant workers and increase their capacity of safeguarding legal rights and integrating into cities;enhance the establishment of labor union in private enterprises and empower them;pay attention to public opinions of labor relation in social media;drive the enterprise to bear social responsibility and make plans for labor relation in the industrial transfer.
