This article is intended to analyze the insufficiency of the present legal regulation on damage caused by drug defect in China，introduce foreign experiences in this aspect，propose that in order to provide the reasonable and sufficient remedy for drug defect damage，it is required to revise identification standards of the product defect，especially drug defect，legislate drug damage regulations，clearly stipulating the no-fault liability principle and limited punitive compensation in drug damage remedy.
