本文从《劳动合同法》有关集体协商的内容入手,论及集体协商制度的形成、历史沿革、理论和法律背景、现实经验、对发展和谐稳定劳动关系的作用和意义,联系现阶段中国的客观实际,重点对工会在集体协商中的作用作了论述,并对集体协商制度在我国的发展进行展望。本文旨在通过理论和实践两方面的论述,明确在社会主义市场经济条件下集体协商对协调劳动关系、促进劳动关系和谐的价值。
<<This report,taking the content of collective bargaining in the Labor Contract Law as the starting point,discusses the emergence,historical evolution,theoretical and legal backgrounds,and actual experiences of the collective bargaining system,as well as its role in and significance for the development of harmonious and stable labor relations. In light of the reality in China at the current stage of development,the report focuses on the role of trade unions in the process of collective bargaining and the prospect of development of collective bargaining system in China. The reports also tries to clarify,from both theoretical and practical perspectives,the value of collective bargaining in the coordination of labor relations and promotion of harmonious labor relations under socialist market economy.
