The source of problems in China’s current road traffic infringement liability and compulsory insurance is the confusion of model positioning in the compulsory insurance.The main models that practicing in the other countries and regions are no-fault insurance，mandatory liability insurance as well as the other forms that between these two models.At this stage，China should select the mandatory liability insurance that closely combined with tort liability as its’ model of motor vehicle compulsory insurance.
