Being directed towards the seriously lag of funeral legislation system in China，and based on the analysis of experience and legislative situation，this report points out that the funeral legislation should focus on the following details：the funeral career development and reform planning，the construction of funeral basic public service system and reforms in funeral customs，and funeral management and law enforcement supervision. Therefore，the management of funeral could be built on the basis of a “good law” and step to the state of “well governed”.
