    2011~2015河南行政执法与刑事司法衔接的现状及完善

    摘要

    “两法衔接”是完善国家权力运行机制、全面推进依法治国的需要。目前,河南省“两法衔接”存在制度创设模式混乱、行政违法与刑事犯罪界限模糊、行政处罚与刑罚的制裁严厉性倒挂、对行政执法机关主动移送涉嫌犯罪案件的监督缺位等问题,应采取以下措施进行完善和改进:制定专门规范“两法衔接”的法律以终结法律依据混乱的局面;及时颁行刑事司法解释,明晰行政违法与刑事犯罪的界限;“两法衔接”应以强化对行政处罚案件的监督为切入路径,以打造执法共享信息平台为技术支撑;完善以检察院为主体的统领行政执法与刑事司法的“两法衔接”机制。

    Abstract

    The connection of two laws’ was the practical requirement that would further the operational mechanism of national authority meanwhile promote the rule by law. Nowadays,following issues existed in the connection of two laws in Henan province:the chaos in model of mechanism establishment,the unclear demarcation line between executive-illegal behavior and the penal crime,the serious reversal of executive punishment and penal punishment,the lack of supervision in transferring the suspected criminal cases which were led by administrative ministers,and so on. The proposals below are the solutions to refine those issues:enact the laws which could purposefully regulate the connection of two laws and terminate the chaotic situations of legislative reason,reinforce the penal executive interpretations,clarify the demarcation line of executive illegal behaviors and the penal crime,intensify the supervision in executing the laws,urge the administrator to legally activate the joint of executions,establish a link mechanism between executive enforcement and penal judicature,which was led by The People’s procuratorate.
