国际刑事法院的管辖权具有补充性的特征,原则上国内法院对国际刑事法院管辖范围内的犯罪享有优先管辖权,国际刑事法院仅可能在出现有罪不罚的例外情形下行使管辖权,如何实现这种管辖权的分配则要依据可受理性标准来判断。《罗马规约》第17条规定了国际刑事法院案件的可受理性标准。本文结合有关补充性原则的学理研究及国际刑事法院的判例,探讨现有法律框架下可受理性标准的构成要件、适用前提,并结合相关判例探讨可受理性标准在司法适用中存在的问题及其完善和解决的途径。本文对补充性原则的规范分析,不仅有助于明确《罗马规约》相关条文的具体含义和适用准则,而且可以为国际刑事法院各缔约国及非缔约国更好地理解和运用《罗马规约》来保护各自的权益提供有利的法律保障。
<<The jurisdiction of the ICC is complementary to national jurisdictions and generally,national courts have primary jurisdiction over crimes regulated in the Rome Statute.Therefore,the ICC only carries out its jurisdiction when there is a possibility of impunity.However,how to realize the distribution of jurisdictions between the ICC and national courts relies on the criteria of admissibility.Article 17 of the Rome Statute regulates the criterion of case admissibility.This article will discuss not only the theory of the principle of complementarity but also combine with case study in order to discover the problems of the application of the principle of complementarity in practice.Through this normative analysis,it is not only helpful to distinguish the meaning of the related regulations in the Rome Statute,but also provide state parties and non-state parties stronger legal protection on their national interests.
