The constitution and the property law is the cornerstone in the protection of human rights in the houses expropriation，and the Regulations on the Expropriation of Houses on State-owned Land and Compensation is the main rule.Compared with the abolished regulation，the new one has many advantages，such as established the rule of fair compensation，made the public interests clear，expanded the scope of the judicial review，cancelled administrative expropriation，established the rule of compensation shall be paid first before relocation.Since then，China’s government at all levels，the judicial authority，the relevant departments of the central and local governments carried out the regulations to protect the legitimate rights and interests of the owners of the houses to be expropriated.Illegal houses expropriation is still exit in the practice，and the satisfaction of the owners of the houses to be expropriated still needs to be improved.Therefore，we need to intensify law enforcement，strengthening information disclosure，improve the compensation mechanism and to establish and improve the relevant legislation.
