本文聚焦于2015年中国劳动关系的变化以及劳动争议的发展特征,对新常态下中国企业劳动争议状况进行了分析研究。指出:第一,劳动争议案件数量居高不下且呈逐年递增态势,不同区域间劳动争议差异显著;第二,中共中央国务院《关于构建和谐劳动关系的意见》助推劳动关系发展,同时,经济发展速度放缓引发劳动争议的增加;第三,在经济新常态下,由产业转型、劳务派遣转型、拖欠工资、新技术新业态等因素引发的劳动争议不断增多。改革传统理念,适应新形势、新问题,加强法制建设,加强政策制度落实等措施是构建和谐劳动关系的重要基础。
<<This paper focused on the changes of China’s labor relations and the development characteristics of labor dispute in 2015. Besides,it analyzed and studied the situation of labor disputes in the China’s enterprises under the new normal. This article pointed out three main ideas. First,the number of labor dispute cases is high and there is a trend of increasing year by year. What’s more,the differences of labor dispute between different regions are evident. Second,the document called “the advice to build a harmonious labor relationship” released by the government boosters the development of labor relations. At the same time,the slowdown of the speed of economic growth caused the increase of labor dispute. Third,under the new normal,the industrial transformation,the transformation of labor dispatching,unpaid wages,new technology and new business modes and so on factors caused the labor dispute to increase. Such measures as the reform of the traditional concept to adapt to the new situations and new problems,to strengthen the construction of legal system,to strengthen the implementation of policy and system are the important foundations of building a harmonious labor relations.
